1. Acceptance of Terms

By accessing or using the NiSa Softwares application, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our Service.

2. Description of Service

NiSa Softwares provides a customer management and automated WhatsApp reminder platform. Features, capabilities, and sending limits vary based on your active subscription tier (Starter vs. Premium API).

3. User Responsibilities and Anti-Spam Policy

You are solely responsible for the content of the messages sent through our platform.

  • Consent: You explicitly agree that you have obtained the necessary legal consent (opt-in) from your customers before sending them automated WhatsApp messages.
  • Spam: You must not use our service to send unsolicited spam, promotional blasts without consent, or illegal content. Doing so will result in immediate account termination without a refund.
  • Compliance: You are subject to Meta's official WhatsApp Business Messaging Policies and all applicable local communication laws.
4. Subscriptions and Payments
  • Premium features (such as Meta API automation and Google Contacts Sync) require an active, paid subscription.
  • Payments are processed securely via third-party gateways (e.g., Razorpay). We do not store your credit card or UPI details on our servers.
  • Subscriptions are billed for the term selected and automatically expire or renew based on your account settings.
5. Limitation of Liability

To the maximum extent permitted by applicable law, NiSa Softwares shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. We are not liable for messages that fail to deliver due to Meta API outages, internet connectivity issues, or incorrect phone numbers provided by the user.

6. Service Availability

While we strive for maximum uptime, we do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue the Service with or without notice for necessary maintenance or updates.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of these Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat.
